OUR RULES
1) Occupancy
a) An owner and or tenant shall not use or permit his strata lot to be used for any purpose other than as a private dwelling house for one family or a group of not more than 5 unrelated persons including servants, borders and lodgers. (As per municipal bylaws);
2) Legal
a) An owner and or tenant shall not use his strata lot to be used for any purpose which may be illegal, or contrary to the provisions of any rules or ordinances of any governmental or municipal authority of which is injurious to the reputation of the neighborhood or to the owners or occupiers of the land and strata lots comprised in Strata Plan 954;
3) Noise
a) An owner and or tenant shall not make or permit undue noise in or about his strata lot or the common property, and no radio, television, musical instruments or other devices shall be used or played or rowdy parties held in a manner which causes a disturbance or interference with the comfort of others. Quiet must be maintained between the hours of 11:00 p.m. and 8:00 a.m. Laundry equipment (washers and dryers) not to be used between the hours of 11:00 p.m. and 8:00 a.m.;
b) An owner and/or tenant shall not cause a nuisance or annoyance to the occupiers of any of the strata lots by the starting or noisy running of an engine, or other device.
4) Pets
a) An amendment to the standard bylaws has been registered with the Land Titles Office on September 25, 2003. Anyone wishing to have a cat may do so, but any cats are restricted to living indoors only. They are not free to roam the property.
5) Exterior of Building
a) An owner and or tenant shall not hang or display on or from windows, balconies or other parts of the building on his strata lot any laundry, washing, clothing1 bedding or other materials or articles
6) Safety
a) An owner and or tenant shall not throw or allow to fall or permit to be thrown or fall any material substance whatsoever out of or from any window, door, stairway7 passage or other part of the strata lot or off the common property;
b) An owner and or tenant shall not do anything on the strata lot, nor bring, nor keep anything therein, which will in any way increase or tend to increase the risk of fire or the rate of fire insurance, or which will invalidate any insurance policy;
c) An owner and or tenant shall not store any combustible, inflammable or other offensive material on his strata lot, except for a reasonable supply of fuel customarily used in domestic fireplaces or for outdoor barbecues.
7) Obstructions
a) An owner and or tenant shall not do or permit to be done anything whereby any obstruction, restriction or hindrance may be caused to the sidewalks, entrances, exits, halls, passages, stairways, vestibules, or other parts of the common property or to a person lawfully using the same;
8) Personal belongings
a) An owner and or tenant shall not leave or permit to be left on the common property any bicycles, tricycles, children’s toys or playthings, or any other items likely to cause an obstruction, restriction or hindrance to other owners, their visitors, licensees, invitees or workmen, and such articles shall be stored by the owner in the building in his strata lot;
9) Garbage
a) An owner and or tenant shall not store or pile dust, rubbish, garbage: boxes, packing cases or the like on any stairway, corridor or passage of the common property, and shall remove all garbage and the like from his strata lot and deposit it in the containers provided by the strata corporation. Owners and tenants are requested to make use of the recycling bins and composters where appropriate.
10) Parking
a) An owner and or tenant shall not place or park anything on the common property without the approval of the strata corporation. Note: There is only parking for one vehicle per strata lot. All visitors to park in the visitor parking area on Morey Road.
b) If vehicles are double parked (on behind the other), they must not impede access to anyone else living here, the waste removal company or any emergency equipment. This double-parking is only to be a temporary measure.
c) No parking at all in front of the garbage bins.
d) Anyone found to be in contravention of this rule will be fined $70.00 per incident.
e) As an owner or tenant you are responsible for your guests.
11) Mechanical repairs
a) An owner and or tenant shall not perform any automobile repairs or repairs to other mechanical equipment on the common property;
b) Any vehicles leaking any fluids shall be cleaned up as soon as possible by the respective owners. Owners are also responsible to ensure that their renters and / or guests vehicles are not leaking fluids. The strata will advise any owners if it finds a problem and will allow a reasonable amount of time for this to be dealt with. If not dealt with within that time, the strata will hire someone else to clean up the spill and the costs for involved costs will be passed on to that unit’s owner.
12) Structural or other alterations
a) An owner and or tenant shall not make or cause to be made any structural alteration either to the interior or exterior of the building on his strata lot or add to or alter the wiring, plumbing, piping or other services on his strata lot, or make any structural alteration within any bearing or party wall or the common property without first obtaining the written consent of the council;
b) An owner and or tenant shall not erect awnings or shades over and outside of the windows on his strata lot;
13) Burning of materials
a) An owner and or tenant shall not burn rubbish or any other material on his strata lot or on the common property, but this restriction shall not apply to the normal use of a fireplace within the building in each strata lot, or an outdoor barbecue;
14) Landscaping
a) An owner and or tenant shall not do or permit to be done anything on the grounds of the common property likely to damage the plants, bushes, flowers, or lawn(s) and shall not place chairs, tables or other objects on the lawn(s) so as to damage them or prevent their reasonable growth or to interfere with the cutting of lawn(s) or the maintenance of the common property from time to time.
15) Recreational area
a) For their own safety children must not play in the parking lot or in the driveway entering into the strata lot(s)
16) Damage to Property
a) The strata corporation shall not be responsible to an owner for any loss, damage or expense caused by an overflow or leakage of water from any adjoining buildings or by the breaking or bursting of any pipes or plumbing fixtures, or in any manner whatsoever.
b) Where the strata corporation is required to enter a strata lot for the purpose of maintaining, repairing or renewing pipes, wires, cables and ducts for the time being existing in the strata lot and capable of being used in connection with the enjoyment of any other strata lot or the common property, the Strata Corporation and its agents shall carry out any work or repairs in a proper and workmanlike manner and shall make good any damage to the strata lot occasioned by such work and restore the strata lot to its former condition, leaving the strata lot clean and free from debris.
c) An owner shall indemnify and save harmless the Strata Corporation from the expense of any maintenance, repair or replacement rendered necessary to the common property or to any strata lot by his act, neglect or carelessness or by that of any member of his family or his or their guests, such expense is not met by the proceeds of insurance carried by the Strata Corporation.
d) When the purpose for which a strata lot is intended to be used is shown expressly or by necessary implication on or by the registered strata plan, an owner shall not use his strata lot for any other purpose, or permit the same to be so used.
17) Smoking
a) Smoking of ANY substances if not allowed in any of the common areas. This means, if smoking outside, the owner or tenant must smoke only at the top of the parking lot entrance – on Morey Road. Currently, under the Strata Act, we have bylaws ensuring owners and strata residents cannot cause a nuisance or hazard to another person or unreasonably interfere with the rights of other persons to use and enjoy the common property, common assets or another strata lot. These bylaws can be used to address second-hand smoke issues. It was decided that rather than create and file a new bylaw restricting smoking anywhere, we can rely on this section in the act to enforce the smoking issue. This can apply to smoke from one unit interfering with the rights of others in adjacent units. At no time should there be any cigarettes butts on the common property or in view on the strata decks. Any cigarette butts should be kept in a tin or can so as to not create a fire hazard or eyesore.
